Article 1 – Definitions

In these General Terms & Conditions, the following definitions apply:

  • Withdrawal period: the period within which the consumer may exercise their right of withdrawal;

  • Consumer: a natural person who does not act in the course of a profession or business and who enters into a distance contract with the entrepreneur;

  • Day: calendar day;

  • Fixed-term transaction: a distance contract concerning a series of products and/or services, the delivery and/or purchase obligations of which are spread over time;

  • Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

  • Right of withdrawal: the possibility for the consumer to withdraw from the distance contract during the withdrawal period;

  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;

  • Distance contract: a contract concluded under a system organized by the entrepreneur for the distance sale of products and/or services, whereby only distance communication techniques are used up to and including the conclusion of the contract;

  • Technique for distance communication: any means for concluding a contract without the consumer and entrepreneur being in the same place at the same time;

  • General Terms & Conditions: these terms.

Article 3 – Applicability

These terms apply to every offer by the entrepreneur and every distance contract and order concluded between the entrepreneur and the consumer. They are made available to the consumer before conclusion of the contract, electronically or in print, as required by law. In case of conflicting provisions, the consumer may rely on the clause most favorable to them.


Article 4 – The Offer

  1. Offers are non-binding and subject to change.

  2. Descriptions and images are indicative; obvious errors do not bind the entrepreneur.

  3. Every offer includes at least: price (including taxes), shipping costs, contract conclusion method, right of withdrawal, payment, delivery and performance methods, validity period, communication costs if any, archival method, data correction procedure, applicable languages, codes of conduct, and minimum contract duration if applicable.

Article 6 – Right of Withdrawal

  1. Consumers have 30 days from receipt to withdraw without reason.

  2. They must handle products and packaging with care and return items unused, in original condition and packaging, with all accessories, following the entrepreneur’s instructions.

  3. Notification of withdrawal must be sent in writing or by email to info@celine-melbourne.com within 30 days of receipt; the items must then be returned within 30 days with proof of shipment.

  4. Late notification or return nullifies the right of withdrawal.


Article 7 – Costs in Case of Withdrawal

If the consumer withdraws, the return shipping costs are borne by the consumer. Refunds will be issued within 30 days of withdrawal, once the product is returned or proof of return is provided.


Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made/special-order items;

  • Personal or hygiene products once unsealed (e.g. underwear, personal care);

  • Perishable or rapidly expiring goods;

  • Sealed audio, video, or software once unsealed;

  • Accommodation, transport, catering, or leisure services on a specific date;

  • Services begun with explicit consent before withdrawal period expires;

  • Betting and lottery services;

  • Other exclusions clearly stated in the offer.


Article 9 – The Price

  1. Prices are fixed during the offer validity, except for VAT changes.

  2. Variable pricing may apply if tied to external market fluctuations, as stated in the offer.

  3. Prices include VAT; customs/import duties are the consumer’s responsibility.

  4. Typographical errors do not obligate the entrepreneur to deliver at incorrect prices.


Article 10 – Compliance and Warranty

  1. Products/services conform to the contract, offer specs, usability and legal requirements.

  2. Any additional warranty from manufacturer or entrepreneur does not affect statutory consumer rights.

  3. Defects or incorrect deliveries must be reported in writing within 30 days of delivery; returns in original, new condition.

  4. Warranty is void if products are modified, misused, or subjected to abnormal conditions contrary to instructions.


Article 11 – Delivery and Execution

  1. Orders are carefully processed and shipped to the provided address.

  2. Delivery occurs within 30 days unless otherwise agreed. Delays or impossibilities prompt notification; the consumer may then cancel at no cost and receive a refund within 30 days.

  3. If a product is unavailable, a replacement may be offered, clearly labeled as such; the right of withdrawal still applies to replacements. Return shipping costs for replacements are borne by the entrepreneur.

  4. The entrepreneur bears the risk of loss or damage until delivery, unless explicitly agreed otherwise.
